Limited Warranty Policy

This Limited Warranty grants you certain legal rights, and you may have additional rights that vary by state.

We guarantee that the Product will be free from defects in materials and workmanship for the duration of the warranty period specified below.

We restrict the duration and remedies of all implied warranties, including but not limited to the warranties of merchantability and fitness for a particular purpose, to the duration of this express limited warranty.

Some states do not allow limitations on the duration of an implied warranty, so the above limitation may not apply to you.

Our liability for any defective product will be limited to repair, replacement, or refund as outlined in this warranty statement below.

WHO IS COVERED BY THIS WARRANTY?

WAVEX™, located at 625 Kenmoor Ave SE Ste 350 #556233, Grand Rapids, MI, 49546 ("we"), extends this limited warranty only to the original consumer who purchased the product ("you") from the WAVEX™ online store. This warranty does not cover any subsequent owner or other transferee of the product.

WHAT DOES THIS WARRANTY COVER?

This limited warranty covers defects in materials and workmanship of the WAVEX™ bottle, taste buds, silicone mouthpiece, straw, strap, and lid (the "product") for the warranty period specified below.

WHAT DOES THIS WARRANTY NOT COVER?

This limited warranty does not cover any damage resulting from: (a) transportation; (b) storage; (c) improper use; (d) failure to follow the product instructions, care instructions, or to perform any preventive maintenance; (e) modifications; (f) unauthorized repairs; (g) normal wear and tear; (h) flavor depletion; or (i) external causes such as accidents, abuse, Acts of God, or other circumstances beyond our reasonable control. Opened or unsealed Taste Bud Packs are not eligible for replacement or refund.

WHAT IS THE COVERAGE PERIOD?

This limited warranty begins on the date of your purchase and lasts for six months (the "Warranty Period"). Taste Buds are warranted until their Best By date. The Warranty Period is not extended if we repair or replace the product. We may modify the terms of this limited warranty at our discretion, but any changes will not be retroactive.

WHAT ARE YOUR REMEDIES UNDER THIS WARRANTY?

For any defective product during the Warranty Period, we will, at our sole discretion, either (a) repair or replace the product (or the defective part) at no cost to you or (b) refund the purchase price of the product. If the specific size, color, or flavor is not available, we may choose to replace the product with a comparable item. We will cover shipping and handling fees to return the repaired or replacement product to you if we choose to repair or replace the defective product.

HOW DO YOU OBTAIN WARRANTY SERVICE?

To obtain warranty service, email us at wavex@customerservice.com within the Warranty Period. Please include photos and/or a video of the issue when submitting your request. After receiving your warranty claim email, our team will respond with questions to help identify the problem and determine the best course of action. You must participate in the warranty team’s efforts to diagnose the problem to receive warranty service.

LIMITATION OF LIABILITY

The remedies outlined in this statement are your sole and exclusive remedies and our entire liability for any breach of this limited warranty. Our liability shall in no case exceed the actual amount you paid for the defective product. Additionally, we shall not be liable for any consequential, incidental, or punitive damages or losses, whether direct or indirect.

Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
